Litigation is the traditional adversarial
model of resolving disputes, where the parties and their attorneys go to
Court to settle their differences, and if the parties cannot reach agreement
a judge decides for them after trial. |

- In litigation either one or both of the parties have
counsel, and the case is initiated by a court filing.
- The parties and their attorneys may have several court appearances
to address various legal issues, and the Court rather than the parties
sets the timetable for the court process and the resolution of the case
either by agreement or by trial.
- Although litigation may be appropriate in some cases, it can be (but
is not always) the lengthier and costlier of the various methods of
resolving family law conflicts.
- There are some disputes which require court intervention, but when
you meet with one of the attorneys in our office, they will discuss with
you whether
collaborative practice,
mediation, or litigation is appropriate in your case.
